If enacted, either bill could prevent you from hearing your favorite band or DJ live. Every musical style would be affected, including rock and roll, Hip Hop, country, and electronic music. Both bills would allow overzealous prosecutors to send innocent people to jail for the crimes of others. The two bills are the RAVE Act (H.R. 718) and the CLEAN-UP Act (H.R. 834). Both could be passed this year without your help. (Links to the Acts text provided below.) The RAVE Act would make it easier for the federal government to punish property owners for any drug offense that their customers commit - even if they work hard to stop such offenses. If enacted, nightclub and stadium owners would likely stop holding events - such as rock or Hip Hop concerts - in which even one person might use drugs. Similarly, the CLEAN-UP Act contains provisions that would make it a federal crime - punishable by up to nine years in prison - to promote "any rave, dance, music or other entertainment event" that might attract some attendees that would use or sell drugs. In both cases, it doesn't matter if the concert promoter and property owner try to prevent people from using drugs. Nor does it matter if the vast majority of people attending the event are law-abiding citizens that want to listen to music, not do drugs. If either the CLEAN-UP Act or the RAVE Act becomes law, Congress could effectively ban live music and dancing, as well as any other event that might attract someone that would use drugs (essentially any event that draws a large crowd). Your help is needed to stop these bills from becoming law!!! Dancing, singing, and playing music should not be a federal crime! BACKGROUND The RAVE Act was first introduced last year in the Senate by Senator Joe Biden (D-DE). A House version was introduced by Rep. Lamar Smith (R-TX). Thanks to the support of thousands of voters like you, Drug Policy Alliance and a coalition of friends and activists around the country was able to stop both bills last year. Unfortunately, supporters of the RAVE Act are even more determined to pass it this year. Rep. Howard Coble (R-NC) is sponsoring a new RAVE Act in the House. Additionally, Senator Biden has introduced a Senate version entitled the Illicit Drugs Anti-Proliferation Act. If enacted, both the House RAVE Act and the Senate Anti-Proliferation Act would make it easier for federal prosecutors to fine and imprison business owners that fail to stop drug offenses from occurring. Businessmen and women could be prosecuted even if they were not involved in drugs - and even if they took steps to stop drug use on their property. Although proponents of the bill are seeking to target raves (and DJs, nightclub owners, and rave promoters have the most to fear), the law would apply to any business owner, including bar owners, motel owners, concert promoters, and cruise ship owners. Because of its broad language, the proposed law would even potentially subject people to twenty years in federal prison if one or more of their guests smoked marijuana at their party or barbecue. For more information on the RAVE Act and Drug Policy Alliance's campaign to stop it, see: http://www.nomoredrugwar.org/music/rave_act.htm A full text of the bill can be viewed at: http://frwebgate.access.gpo.gov/cgi-bin/getdoc.cgi?dbname=108_cong_bills&docid=f:h718ih.txt.pdf (Please cut and paste the entire URL into a browser window) The CLEAN-UP Act was also first introduced last year, but it failed to make it out of committee. This year's bill already has over 60 co-sponsors and could become law without your help. Sponsored by Rep. Doug Ose (R-CA), the Clean, Learn, Educate, Abolish, and Undermine Production (CLEAN-UP) of Methamphetamines Act is largely an innocuous bill that provides more money and training for the clean up of illegal methamphetamine laboratories. Hidden within the bill, however, is a draconian section that could make dancing and live music federal crimes. Section 305 of the CLEAN-UP Act stipulates that: 'Whoever, for a commercial purpose, knowingly promotes any rave, dance, music, or other entertainment event, that takes place under circumstances where the promoter knows or reasonably ought to know that a controlled substance will be used or distributed in violation of Federal law or the law of the place where the event is held, shall be fined under title 18, United States Code, or imprisoned for not more than 9 years, or both.' Under the provision, any concert promoter, nightclub owner and arena or stadium owner could be fined and jailed, since a reasonable person would know some people use drugs at musical events. A full text of the bill can be viewed at: Opponents of the bills fear that both proposed laws would be used by racist or homophobic prosecutors to target Hip Hop and R&B concerts and gay and lesbian nightclubs. Both bills would also eradicate electronic dance music and culture, as we know it. ACTIONS TO TAKE *** Fax your Representative. This legislation will target ANY music event, not only Raves. At Orchestral events held 'under the stars' I have smelled the strong scent of -many- reefers on the breeze, a concert performing classical music. Now, will they pass the same legislation for..say.. outdoor sporting events? If not, why? I have seen people use dope at these also. As for raves not paying taxes, well.. maybe not but I do have some first hand knowledge of this. Our company plans Raves, promotes DJs, deals with the 'music' industry, etc and not all Raves are 'secret' and hidden from the authorities. Many -do- pay for licenses, renting 'sites', paying for DJs (which generally includes travel expenses, hotels, transportation) which is not cheap, paying for security, for sound equipment and more. Raves are not -just- about drugs and music. So, remember that legislation will (if passed) cut -everyones- freedoms. Learn more about it. Check out the GOV sites. About Bush's 'full plate'. Yes, he has plenty of things on his mind at the moment, most of which is taken care of by his advisors (and possibly puppet-masters), but the 'War on Drugs' is VERY much his concern. Remember he and his father, plus others of his cabinet, have major holdings in the Pharmaceutical industry. Family holdings in Libby Pharmaceuticals is extensive. Papa Bush wanted vitamins and natural suppliments off the market. Healthy people don't generally need lots of drugs prescribed. That is still an ongoing battle. Now, about the War. War has not been declared as of yet. Hopefully it will not. Yes, I am concerned about the possibility; I have a son that is less than three months from his college graduation, yet he is due to hear at the first of this next week -when- he has to leave his wife, his 1 1/2 year old daughter and his newborn baby boy, -and- where they are shipping him. I have a son-in-law who is going through Tank training at this moment and he has been told he -will- be going over after training. He will be given 2 weeks to settle his family, my daughter and their 2 1/2 year old son, on some, as yet unknown, stateside Army base. I have another son who might be called up, but luckily will not be sent into the field. So, am I concerned about a war? Yes. Am I thinking of nothing BUT the possibily of this War? No. I have a life to live and at this point that is one of my highest concerns, along with my family and friends. Another concern is - why are we going to be fighting this war? Is it -only- the atrocities that that lunatic has commited? Is it for the millions of suffering people under that lunatics iron fist? Is it the shortage of a resource we 'so desperately' need? There is more to this issue than just what is being touted. Investigate. Another point, what freedoms will our men have to come home to if these types of legislation is passed? Just my ranting... -------------------------- Message 9154 from *Chat (#5391): Date: Mon Mar 10 01:07:57 2003 EST From: Nny (#25135) To: *Chat (#5391) Subject: re: Clayson You have a son who is 16? But if your favorite President keeps the war machine churning, I'm sure he'll have a war to die in once he hits the big one-eight! =) As someone who has first-hand knowledge of this: ironically, the new piece of legislation that DB is referring to -- IIRC -- is the one that will put the big axe on those raves which -are- commercial/mainstream events, do pay the state for licenses, do pay tax on their revenue, etc. I'm almost tempted to say this shit should go down, because it'd drive the scene back underground where it belongs... but, as previously mentioned, this doesn't deal just with raves -- the implications are much broader than that. Earlier this month the DEA shut down several online retailers of 'tobacco accessories' -- a number of online and real-world head shops. Bush may have a great deal on his plate, but apparently the 'war on drugs' needs to show some results -- and this is part of the ongoing process. More arcane laws = more 'drug' related busts = the DEA not looking like a bunch of shit-eating gibbons, thus pleasing Herr Bush. I wonder if he just realizes he's going to end up driving up the price of cocaine. Oh, wait. Most of the busts the DEA has been making involve drugs which are imported from europe or manufactured in the US. The heroin and cocaine trades -- the massive spending money fund for the CIA -- are still going strong. The drugs that annihilate lives are getting cheaper every day, actually. Did you know the Taliban burned all the opium fields? That now that Bush has kicked them over, heroin is being grown again? And is cheaper than ever? Did you know that cocaine is now cheaper on the street than indoor-grown bud, in many parts of the US? Of course you didn't. But, you know -- REEFER MADNESS. Marijuana kills. Pfft. This article first appeared in The Daily Star (http://dailystar.com.lb) on 11 March 2003. In his 6 March press conference, President George Bush once again issued a series of assertions that are unsupported and even contradicted by the available evidence. What is most disturbing is the abject failure of the US media to subject Bush's statements to any form of scrutiny. To take just one example, Bush, in listing justifications for a US attack on Iraq, asserted that "There is a poison plant in Northeast Iraq." This was merely a repetition of the claim Secretary of State Colin Powell made in the Security Council on 5 February, when he displayed a satellite photo of the alleged site. The Observer's Luke Harding who was among a group of journalists who visited the site, wrote: "If Colin Powell were to visit the shabby military compound at the foot of a large snow-covered mountain, he might be in for an[to ]: only the smell of paraffin and vegetable ghee used for cooking. In the kitchen, I discovered some chopped up tomatoes but not much else."("Revealed: truth behind US 'poison factory' claim," The Observer, 9 February 2003) The BBC and even the US network;ABC carried reports from their journalists that concurred;completely with this version. Yet the issue got almost no attention, and neither Powell nor Bush has been asked to explain how such flimsy 'evidence' could be used to justify a war. Another disturbing example involved the arrest on 31 January of 28 Pakistani men in Naples, whom Italian authorities sensationally claimed were part of an Al-Qaida terror cell. That same day, however, it was apparent that there was much less to the story: the Associated Press reported that an Italian "police official, speaking on condition of anonymity, said late Friday officers "might have gotten ahead of themselves" in announcing an al-Qaida link in the headline of their press release." ("Italian police arrest 28 Pakistanis, find explosives, maps," Associated Press, 31 January 2003) Bush, who always claims that he is defending "freedom" and American "values" did not accord the Pakistanis the presumption of innocence until guilt is proven, that is a basic tenet of the American legal system. Rather, at a 31 January joint press conference with UK Prime Minister Tony Blair, President Bush announced boldly, "Today Italy rounded up yet another cell of people who are willing to use weapons of mass destruction on those of us who love freedom."; Not even the Italians had alleged that "weapons of mass destruction" were involved in the case. And on 13 February, buried deep on page 27, The Washington Post carried in its "World in Brief" section, a few sentences about the case, among them that, "An Italian judge ordered the release of 28 Pakistanis arrested last month on suspicion of plotting a terrorist attack, saying there was not enough evidence to hold them, according to a court statement. The ruling represented a blow for the Italian police, who have seen a umber of high-profile terrorism It would appear that the men were what they and their defenders said all along: poor immigrants struggling to make money to send home, who happened to be in the wrong place at the wrong time. These are just two of many cases where presidential assertions of "fact" turn out to be inconsistent with all available evidence. The President and other administration officials also seem unwilling to take into consideration any alternative explanation. This phenomenon has not gone entirely unnoticed. The Washington Post reported last October that, "As Bush leads the nation toward a confrontation with Iraq and his party into battle in midterm elections, his rhetoric has taken some flights of fancy in recent weeks. Statements on subjects ranging from the economy to Iraq suggest that a president who won election underscoring Al Gore's knack for distortions and exaggerations has been guilty of a few himself." ("For Bush, Facts Are Malleable Alas the Post story was a remarkable aberration for a press corps that almost always defers to official prounouncements. This was evident in the 6 March press conference, where the tone of the journalists can only be described as obsequious and deferential in the extreme. Many American journalists place themselves rhetorically on the side of the government, when they regularly refer to "our armed forces," "our allies," and "our policy." They ask questions about whether and when "we will attack Iraq." This kind of language, in which there is no distance between the journalist and the government creates the illusion of a national consensus in which the considerable opposition to the war in the United States is totally marginalized as something which lies outside the norm. No wonder then that Americans are so misinformed and confused. Fifty-seven percent of Americans still believe that Iraq was involved in the 11 September 2001 attacks, according to a survey published on 20 February by the Pew Research Center. Not even the Bush administration has ever advanced this conspiracy theory. Few other democratic governments enjoy such carte blanche from the media. After Powell cited in the Security Council a "fine" British "intelligence analysis" about Iraqi deception, the UK media quickly revealed that the document was a shabby "cut and paste job" by prime minister Tony Blair's public relations staff, made up of old, published articles and plagiarized sections from a student paper. While the affair became a major story in the UK, costing Blair the little credibility he had left, it went unnoticed in the United States. In an ominous sign of how determined the Bush administration is to restrict what Americans see, the President advised that when the US attack on Iraq begins, "The journalists who are there should leave. If you're going, and we start action, leave." There is little reason to hope that many will not obey this 'advice' and Americans will be left even more in the dark than they are now. -------------------------- Message 9161 from *Chat (#5391): Date: Thu Mar 13 14:08:16 2003 EST From: Vertemis (#23360) To: *Chat (#5391) Subject: Yay! The sources said the two also sought to have a test-tube baby together, and affirmed to Mount Lebanon assistant public prosecutor Shawki Hajjar that they would join each other once released from jail. Hajjar ordered that each woman be held in custody in a separate cell on charges of having unnatural sexual relations. Article 534 of the penal code identifies having sexual relations contradicting the laws of nature as a crime carrying a penalty of up to one year in prison. The sources said the womens relationship was exposed after police stormed one of their homes to recover money and jewelry allegedly stolen from the mother of one of the women. The mother had filed a complaint against her daughter, accusing her of stealing the valuables. Both women were also charged with theft, which under Article 636 carries a penalty of between two months and three years in prison.
